Welcome to VAOCITY, LLC and HYPR Service ("VAOCITY," "HYPR Service," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, products, and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

3. Refund Policy

We strive to ensure your satisfaction with our services. Please review our Refund Policy for information on refunds, cancellations, and returns.

4. Cancellation Policy

Clients may cancel services by providing a written notice to [email protected], with a minimum of 30 days' notice. Immediate cancellations are not permitted. Upon cancellation, any remaining deposit payment may be utilized or forfeited, and no refunds will be issued for services already rendered. The company reserves the right to amend this cancellation policy without prior notice. For inquiries or concerns regarding cancellation, clients may contact the company for assistance.

5. Payment Policy

By engaging with our Services, you consent to adhere to our Payment Policy, designed to facilitate a seamless and transparent transaction process for our clients. By granting VAOCITY, LLC and/or HYPR Service permission to debit their accounts for approved purchases, clients are assured of a straightforward billing experience. We are committed to offering clear payment terms, including refund policies, to ensure customer satisfaction and foster lasting trust.

6. Non-Discrimination Policy

We are committed to providing equal opportunities and fair treatment to all individuals. Discrimination based on race, gender, age, religion, disability, or sexual orientation is prohibited.

7. Security Policy

Our Security Policy prioritizes safeguarding client data and maintaining the integrity of our systems. Through robust encryption, regular security audits, and strict access controls, we ensure the confidentiality and protection of sensitive information. Additionally, our team undergoes continuous training to stay updated on emerging threats and best practices, enabling us to uphold the highest standards of security across all operations.

8. Payment Authorization

I authorize VAOCITY, LLC and/or HYPR Service to charge my account(s) for the purchase price as agreed. Refusal to honor a transfer may incur additional charges. The billing statement will show the company name, VAOCITY, and/or its affiliates (HYPR Service, HYPR Assistants, HYPR Callers, HYPR Agents, HYPR Pods) with the authorized amount. This authorization lasts until I provide a written cancellation notice.

VAOCITY is not required to provide any services, training, or information until full payment is received.

9. Non-Refundable Service Guarantee Fee

Subscription Service Guarantee Fee Requirement: Prior to the commencement of subscription-based services, clients are required to submit a non-refundable service guarantee fee, securing their subscription and ensuring commitment to the service.

Service Guarantee Fee Usage and Policy Clarity: The service guarantee fee serves as a credit towards final month subscription fees and is non-refundable. This policy aims to provide transparency and clarity regarding service guarantee fee utilization and non-refundability, ensuring mutual understanding between the client and the service provider.

Example: Before starting the Managed Callers plan, clients must pay a service guarantee fee equal to the last month's fee, which is non-refundable but credited towards the final month's bill if services are canceled.

10. Cancellation/Refund Policy

Full refunds for set-up and direct hire fees are guaranteed within seven (7) business days of the sale. After this period, all sales are final, and no refunds will be issued. Refund requests must be emailed to [email protected] with the subject line: "Request For Refund." Clients must provide a 30-day written notice to cancel services, sent to [email protected]. Immediate cancellations are prohibited, and the deposit payment may be utilized or forfeited. Clients agree to adhere to this policy, with the company reserving the right to amend it without prior notice.

11. Nonpayment and Collection Policy

Our company requires timely and consistent payment for services.

If a payment is overdue, we will first remind the client of their balance. After 30 days, services may be suspended until payment is received. After an additional 30 days without payment, we may initiate legal action and the account could be sent to collections.

Clients sent to collections will cover all fees and costs, and their credit score may be affected. Clients facing financial difficulties should contact us immediately to discuss payment options. We aim to work with our clients to find solutions.

12. Limitation of Liability

To the extent permitted by law, HYPR Service shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

13. Fees

Service set-up fees are charged upon agreement of services and are allocated to cover recruitment, training, and all onboarding services. These fees are non-refundable.

14. Subscriptions

For customers purchasing a subscription with recurring payments for our managed plan and protection plan services, they agree to be automatically charged or invoiced the current monthly subscription fee to their credit card or checking account monthly on the same date as the original transaction until subscription cancellation.

The original transaction date will be specified in an email, typically coinciding with the commencement of remote professional services, subject to change. Customers acknowledge our right to extend their credit card expiration date.

15. Remote Pod Services

Introduction of Remote Pod Services: By subscribing to our Remote Pod Services, you agree to a monthly fee for a team of executive admins who collaboratively manage your daily tasks. The subscription is billed monthly, with the same terms as other managed services. The Remote Pod plan offers comprehensive administrative support, designed to streamline your business operations.

16. Modifications to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be posted on this page, and your continued use of the Services after any changes have been made constitutes your acceptance of the new Terms.

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
